Phoenix Jones, who was recently unmasked as 23-year-old Benjamin Fodor, was arrested in October after using pepper spray on several people he believed were involved in a fight.

He was charged, but a "proof problem" lead the city attorney to drop the case on Wednesday, according to the Seattle Post Intelligencer.


"Two men at the heart of the alleged fight ran from the scene, and attempts to identify and interview them have been unsuccessful," Seattle City Attorney Pete Holmes said in a press release.

However, he stressed that just because they aren't going to prosecute in this case, doesn't mean Fodor should continue his vigilante ways.

"Mr. Fodor is no hero, just a deeply misguided individual," Holmes said, "He has been warned that his actions put himself in danger, and this latest episode demonstrates that innocent bystanders can also be harmed."

Fodor lost his job as a teacher who works with autistic children when his identity was revealed following his assault charge.

The Oct. 9 incident was captured on video. Fodor, wearing gold and black outfit with a mask, rushed in during what he believed was a group of people fighting.

When he attempted to break it up, several of the people - who claimed they were merely hanging out - chased after him, including two women.

No one but Fodor was charged with any crime relating to the confrontation.
