Smith Walker named in second suit,For the second time this week, San Francisco 49erslinebacker Aldon Smith and former 49ers tight end Delanie Walker were named in a lawsuit stemming from a 2012 party at Smith's San Jose home.

The second lawsuit was filed in Santa Clara County from an attorney for Aaron Reyes, a friend of Ronndale Esporles, the plaintiff in the first lawsuit that was filed earlier in the week, according to nbcbayarea.com.

Like Esporles, Reyes also received serious, catastrophic and permanent injuries, according to Reyes.

The lawsuit claims that Smith and Walker knew that gang members and others armed with weapons were at the party. It also claims that Smith hosted other similar parties.

"Defendant Smith has already established a pattern of having wild and boisterous parties at his home," the lawsuit said.
Further, the party was widely advertised, including on the internet, and that "drugs were used in an open and notorious fashion at the party," according to the suit.

Finally, Reyes claims that Smith and Walker charged patrons for drinks.

"The 49ers organization has been aware of this matter concerning Aldon Smith for some time," general manager Trent Baalke said in a statement. "We will continue to monitor the situation closely, but will have no further comment at this time, as this is an ongoing legal matter."

Earlier in the week, coach Jim Harbaugh said, "the team is handling it," when asked about the first lawsuit.

Also, Smith said about the first lawsuit that he was not surprised by it but would not further comment on it.

Walker currently plays for the Tennessee Titans.
